If you've decided to pass on an applicant based on their background check results, FCRA regulations state that you must physically send this letter, a copy of their results, and the Summary of Rights.

If no dispute is filed by an applicant regarding their results provided to them in the pre-adverse mailer, and you've provided them a reasonable amount of time to review their results, you must send this letter.

Employers are required to provide their applicants with a copy of this document at the time adverse action is taken against them. Please dispatch a copy of this with any pre-adverse action letter you send.
